PRIVACY POLICY FOR THE WEBSITE OF PLATH SIGNALPRODUCTS GMBH & CO. KG
1. Subject matter of this privacy policy
Thank you for your interest in our website and our offers on our web pages. The protection of your personal data (hereinafter referred to as “data”) is a major and very important concern for us. In the following, we would therefore like to inform you in detail about which data is collected when you visit our website and use our offers there, and how this data is processed by us in the following. In addition, we would like to inform you about the rights to which you are entitled and the technical and organisational protective measures we have taken with regard to the processing of your data.
2. Name and address of the data controller and service provider
PLATH Signalproducts GmbH & Co KG (hereinafter also referred to as “we”) is the responsible party within the meaning of the General Data Protection Regulation (GDPR) and at the same time the service provider within the meaning of the German Telemedia Act (TMG), cf. our imprint.
Please address any questions or comments regarding this data protection declaration or with regard to data protection in general to our data protection officer either via datenschutz@plath.de or via our postal address with the note “for the attention of the data protection officer”.
3. Collection and processing of your data
The extent and type of collection and processing of your data differ depending on whether you visit our website only to retrieve information or whether you use offers on our website that require you to provide further data about yourself, for example when using our contact form:
a) Informational use
For the purely informational use of our website, it is generally not necessary for you to provide personal data. Rather, in this case we only collect and use the data that your internet browser automatically transmits to us, such as:
- date and time of the retrieval of one of our internet pages
- your browser type
- the browser settings
- the operating system used
- the page you last visited
- the amount of data transferred and the access status (file transferred, file not found, etc.) as well as
- your IP-address.
We collect and use this data during an informational visit exclusively in a non-personal form. This is done in order to enable the use of the internet pages you have accessed and to be able to check whether our web pages are displayed in an optimal manner for you. We only use the IP address for the duration of your visit and store the data for logging purposes, exclusively in anonymised form (cf. also section 4 and 5), by shortening the IP address so that it can no longer be assigned. The processing is carried out on the legal basis of Art. 6 para. 1 sentence 1 lit. f) GDPR (balancing of interests) and in our interest to be able to display our website to you reliably and as trouble-free as possible.
b) Use of the contact form
If you wish to contact us via the contact form provided on our website, we will collect the following data from you:
- subject of the request
- first name
- surname
- society/organisation
- country
- e-mail address
- telephone number
- your message to us
We use this data to be able to respond to your request.
Insofar as your enquiry relates to an existing contractual relationship with you or you are interested in concluding a contract, for example the purchase of one of our products, the data processing is carried out on the legal basis of Art. 6 Para. 1 Sentence 1 lit. b) GDPR (contract initiation and fulfilment).
Otherwise, the data processing is carried out on the legal basis of Art. 6 para. 1 sentence 1 lit. f) GDPR (balancing of interests) and in our interest to be able to answer your enquiry with the information relevant to you.
We store the data collected via the contact form and the communication to answer your request for 3 (three) months.
c) Registration for receiving newsletter
If you wish to receive our newsletter, you can register for it by filling in the form “GET OUR NEWSLETTER” on this page. In the form we collect the following personal data: First name, last name, company and the e-mail address to which the newsletter will be sent. After completing the form entry, we will send an email with a link for confirmation. After that, the registration process is completed. We use your data only for sending the newsletter. You can object to the use of your data at any time. Thereupon, we will immediately delete your data and you will no longer receive newsletters.
4. Use of cookies
We use the technology of cookies for our website. Cookies are small text files that are sent to your browser by our web server when you visit our website and are stored on your end device for later retrieval.
a) Which cookies do we use?
This site uses first-party and third-party cookies as listed below:
aa) First-Party Cookies: [waconcookiemanagement].
Function: Identification of your session on the server. It contains an alphanumeric string. This cookie is stored until the end of your session and is a so-called first-party cookie, i.e. a cookie controlled by our website.
bb) Third-Party Cookies: We do not use any Third-Party Cookies
b) Deactivating cookies
You can determine yourself whether cookies can be set and retrieved through the settings in your browser. For example, you can completely deactivate the storage of cookies in your browser, limit it to certain websites or configure your browser so that it automatically notifies you as soon as a cookie is to be set and asks you for feedback. You can block or delete individual cookies. However, for technical reasons, this may result in some functions of our website being impaired and no longer functioning fully (cf. also section 6). In addition you may declare and withdraw your consent at any time on this website.
5. Use of Matomo
We use the web analytics service Matomo to analyse and regularly improve the use of our website. The statistics obtained allow us to improve our offer and make it more interesting for you as a user. The Matomo software and the data collected using Matomo are operated, stored, and processed exclusively on our own servers.
We use Matomo with an extension to anonymize IP addresses. As a result, IP addresses are further processed in a shortened form, and direct inference to a person is excluded. Your IP address collected in this way is neither merged with other data collected by us nor passed on to third parties.
If individual pages of our website are called up, the following data is stored:
- two bytes of the IP address of your calling system (anonymous)
- browser type and version
- operating system used
- the website called up
- the website from which you are visiting us (referrer URL) – if your browser does not prohibit this
- the pages and files you access on our website
- if applicable, the website you visit after ours (when clicking on an external link on our website)
- the date and time of your access
- your time spent on the website
- the frequency of your visit to the website
- your location (country)
No tracking cookies are placed on your computer as part of our web analytics.
If you do not agree with the anonymous storage and analysis of the data, then you have the option to object at any time by mouse click. Then an opt-out cookie will be placed in your browser with the consequence that Matomo will no longer collect any session data. To do this, you must remove the following check mark.
5. Engagement of service providers and transfer to third parties
In order to provide this website and for the aforementioned purposes, your data may be passed on to technical service providers within the European Union or the European Economic Area, who support us for example with website hosting, technical support, quality assurance or mailing service, which we have of course carefully selected and commissioned in writing on the basis of a data processing agreement.
These service providers are bound by our instructions and are regularly monitored by us.
Your data will otherwise only be passed on to third parties, if expressly stated in this data protection declaration under reference to the applicable legal basis, on the basis of your consent or if we are legally obliged to do so.
6. Your rights
Insofar as the legal requirements are met in each case, you have the following rights:
You have the right to request confirmation from us as to whether personal data concerning you is being processed; if this is the case, you have a right to information about this personal data and the information listed in detail in Art. 15 GDPR.
You have the right to demand that we correct any inaccurate personal data relating to you and, if necessary, complete any incomplete personal data without delay (Art. 16 GDPR).
You have the right to demand that we delete personal data relating to you without delay, provided that one of the reasons listed in detail in Article 17 of the GDPR applies, for example if the data is no longer required for the purposes pursued (right to erasure).
You have the right to demand that we restrict processing if one of the conditions listed in Art. 18 GDPR applies, for example if you have objected to the processing, for the duration of the review by us.
You have the right to object at any time to the processing of your personal data for direct marketing purposes. You also have the right to object at any time, on grounds relating to your particular situation, to processing carried out on the basis of Article 6 (1) sentence 1 e) or f) GDPR (Article 21 GDPR). You will find a supplementary note on the right to object at the end of this data protection declaration.
You have the right to revoke any consent you have given us at any time with effect for the future (right of revocation).
You have the right to receive from us the data concerning you that you have provided to us in a structured, common and machine-readable format. You can also transfer this data to other bodies or have it transferred by us (right to data portability).
Please contact datenschutz@plath.de to exercise your rights.
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority if you consider that the processing of personal data concerning you infringes the GDPR (Art. 77 GDPR). A list of the German data protection supervisory authorities and their contact addresses can be found at:
www.bfdi.bund.de/DE/Infothek/Anschriften_Links/anschriften_links-node.html.
7. Data security
We also use technical and organisational security measures to protect personal data that is generated or collected, in particular against accidental or intentional manipulation, loss, destruction or against attack by unauthorised persons. Our security measures are continuously improved in line with technological developments.
Your personal data is also encrypted using SSL/TLS technology to prevent access by unauthorised third parties.
8. Note on the right of objection
You have the right to object at any time to the processing of your personal data for direct marketing purposes. You also have the right to object at any time on grounds relating to your particular situation to processing carried out on the basis of Art. 6 (1) sentence 1 e) or f) GDPR (Art. 21 GDPR).
We will then no longer process the personal data for direct marketing purposes and otherwise only if we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing is for the assertion, exercise or defence of legal claims.
